摘要
确切地说,对于“小产权房”的兴起时间,大家并没有一个统一的标准和共识。但对于今天“小产权房”的发展规模和影响力,社会各界都一定有比较清晰的认识和判断,那就是已到了不可忽视的地步了。看看去年以来我国政府有关主管部门发出的关于解决“小产权房”问题的各种坚定和果断的信号,我们不难看出,解决“小产权房”问题已经迫在眉睫,己经不能再等了。但是,究竟怎么看待和如何解决“小产权房”问题,政府决策部门、学术界、各种团体及人民群众都再次提出了不同观点。在这敏感时期,笔者认为有必要根据自身所学和自己的了解及体会发表一些看法。
众所周知,相对于号称“大产权房”的商品房来讲,“小产权房”其实是没有正式产权的各种未经国家许可建设和出售的房屋,既然如此,根据相关法律规定,购买此类房屋,购房者的权益是很难得到保障的,国家有关部门始终对此有所强调和警示,甚至通过此类执法证明政府之立场,但效果似乎并不明显,“小产权房”问题依然突出和严重,甚至愈演愈烈,直至今天依然是建售两旺的局面。
首先,应当承认,“小产权房”的大建大造的确破坏了我国房地产市场的健康和良性发展,造成了我国土地资源的很大浪费,严重破坏了我国的自然环境和生态平衡,也极大威胁了我国18亿亩耕地的红线,对其依法处理是我国法治建设的内在需要,也是符合我国整体发展要求和趋势的。但是,同时也不可否认,“小产权房”问题的产生并不是短期内造成的,更不是一般的比较单一的社会问题,它是多种社会因素综合作用的结果,也是社会不同利益群体博弈的产物,需要我们通过运用法律的思维、发展的眼光、集体的智慧等综合手段来解决它。
对此,笔者通过了解“小产权房”产生的历史背景和经济因素,从维护社会稳定大局、国家长治久安和改善巩固民生以及遵守宪法的角度,运用粗浅的法律思维和有限的社会知识,认为应当对小产权房采取有条件、有差别地予以合法化,使之得到转正,融入我国房地产市场经济秩序中,更好地促进房地产市场的健康发展,同时也帮助人民群众最终实现“人人有所居”的“住房梦”.

ABSTACT
Specifically, the “small property room” rise time ,everybody doesnot have a unified standard and consensus. But for today, “the smallproperty right house” development scale and influence, all circles of thesociety must have a clear understanding and judgment, that is to the pointcan not be ignored. Have a look since last year ,relevant departments ofour government issued a variety of “small property room” on thesettlement of the firm and decisive signal, we see not hard, to solve the“small property room” issue has been imminent, can't wait any longer.
However, how to treat and how to solve the “small property room”problem, government, academia, various groups and people once againput forward different views .In this sensitive period, the author thinks it isnecessary according to their own knowledge and experience and hisunderstanding of a comment.
As everyone knows, the so-called “property right” houses,“smallproperty room” is in fact a variety of no formal property rights withoutstate permission construction and sale of housing, since it is so, inaccordance with relevant laws and regulations, the purchase of suchhousing, the purchase of the rights is very difficult to obtain the safeguard,the relevant departments of the state has always been to emphasize andwarning, even by such law enforcement proves that the government'sposition ,but the effect does not seem obvious, “small property room”problem is still serious, and even intensified, until today still build saleprosperous situation.
Admittedly, “small property room” did damage to China's real estatemarket health and benign development, causing a great waste of landresources in China, serious damage to our natural environment andecological balance, a great threat to our 1800000000 acres of arable landred line, according to its processing is the internal need of China's rule oflaw, is also in line with China's overall development and trend. But, at thesame time, it can not be denied, “small property room” problem is not theshort term caused by social problems ,not the general, it is thecomprehensive effect of various social factors, is also a product of gameof interest groups in different society, we need to through the use of legalthinking, the vision of development, collective wisdom comprehensivemeasures to solve it.
Therefore, the author through the understanding of “small propertyroom” the historical background and economic factors, from maintainingthe overall national long period of stability, social stability and improvingpeople's livelihood and consolidate angle respect the constitution ,usingrudimentary legalThinking and limited knowledge of the society, that should be takento be legalized conditions, there are difference son the small propertyright room, be positive, into the economic order in the real estate marketof China, to better promote the healthy development of the real estatemarket, but also to help people realize the “everyone is in the” housingdream“.
